Terms & Conditions
The terms that apply when you request a quotation or work with ABL Design & Build on your renovation, extension or new build project.
About These Terms
These terms explain how ABL Design & Build Ltd (also trading as Active Builders London) provides design, construction and refurbishment services.
They apply alongside your quotation and project contract. If terms conflict, your signed contract takes priority, subject to applicable law and statutory rights.
Consultations & Quotations
- Initial consultations and quotations are free unless agreed otherwise.
- Quotations are based on available drawings, specifications and site information.
- Quotations remain valid for 30 days unless stated otherwise.
- Provisional costs may change when further information becomes available.
- All quotations will specify VAT, exclusions and provisional allowances. Additional costs require prior agreement, except for urgent safety measures.
Agreeing to Proceed
A contract is formed when you accept our quotation in writing or sign a project contract.
The agreement will confirm the scope, price, payment schedule and estimated timeline. Required consumer information will be provided before you become contractually bound.
Changes to the Works
Changes to the agreed works must be confirmed in writing, including any impact on cost or timing.
Unforeseen issues will be discussed before additional work begins, except where immediate safety action is necessary. We will notify you promptly of such action and costs.
Your Responsibilities
You agree to:
- Provide reasonable site access and necessary utilities.
- Protect or remove personal belongings from work areas.
- Disclose known property issues.
- Make timely decisions about materials and finishes.
These responsibilities do not reduce our statutory duties or obligations concerning workmanship and safety.
Planning, Building Regulations & Party Walls
You are responsible for obtaining necessary permissions unless we agree otherwise in writing.
Your contract will identify responsibility for planning applications, Building Regulations approvals, inspections and completion certificates. Both parties must comply with applicable statutory duties, including CDM 2015 requirements.
Programme & Delays
Project timelines are estimates and may change due to weather, material shortages, approvals or unforeseen conditions.
We will communicate significant delays, take reasonable steps to minimise disruption and provide revised timelines where possible. Your statutory rights remain unaffected.
Payments
- Deposits and stage payments follow your agreed payment schedule.
- Invoices are payable within seven days unless stated otherwise.
- We may suspend work for overdue payments after reasonable written notice, subject to applicable law.
- Disputed invoices will be reviewed fairly before action is taken concerning the disputed amount.
- Deposits, refunds and material ownership are subject to applicable consumer law.
Site Safety & Conduct
We maintain safe working areas and aim to minimise disruption. Children, pets and visitors must stay clear of active work zones.
We comply with applicable health and safety requirements, including CDM 2015, and maintain appropriate business insurance.
Completion & Aftercare
We will inspect completed works with you and agree any outstanding snagging items.
Workmanship defects will be investigated and remedied where we are responsible. Contractual warranties and defects periods do not limit your statutory rights.
Manufacturer warranties are provided where available. Normal wear, misuse and unrelated third-party work are excluded unless we remain legally responsible for the damage.
Your Right to Cancel
For qualifying distance or off-premises service contracts, consumers generally have 14 days to cancel. Certain construction contracts, including new buildings and substantial conversions, are excluded.
Where cancellation rights apply, we will provide the required information and cancellation form. If you expressly request an early start, proportionate charges may apply where legally permitted.
Other cancellation arrangements remain subject to your contract and applicable consumer law.
Our Liability
We provide services with reasonable care and skill.
Nothing excludes liability for negligence causing death or personal injury, fraud or other liability that cannot legally be excluded.
We are not responsible for unforeseeable losses or events beyond our reasonable control unless we remain legally liable. Your rights under the Consumer Rights Act 2015 remain unaffected.
Designs & Intellectual Property
Our drawings and designs remain our intellectual property. Once paid for, you may use them for the agreed project, subject to applicable third-party rights.
We will seek appropriate permission before using identifiable project photographs for marketing and will respect your privacy.
Complaints, Privacy & Governing Law
Please contact us if you have a complaint. We will investigate it fairly and provide information about applicable dispute resolution options where required.
Personal information is handled under our Privacy Policy.
These terms follow the laws of England and Wales, subject to mandatory consumer rights. Termination arrangements follow your project contract and applicable law.
The terms in force when your quotation is accepted will apply to your project.
